Terms of Use

These Terms of Use ("Terms") govern your use of the Heart of Living Yoga mobile app on iOS and Android ("the app"). The app is provided by Arcturus Digital Consulting Ltd on behalf of Heart of Living Yoga (registered charity no. 1169252). By using the app, you agree to these Terms. If you do not agree, please do not use the app.

Heart of Living Yoga is currently in development. These Terms describe how the app is intended to operate at release and may be updated before or after launch.

What the app is

Heart of Living Yoga offers guided practices, live daily meditations, yoga class videos, a music library, information about retreats and events, and ways to support the charity. It is intended for general wellbeing, education, and community, and is not a medical service.

Health and safety notice

You are responsible for practising safely and within your own limits. Consult a qualified healthcare professional before beginning any new practice, especially if you are pregnant, recovering from injury or surgery, or have any health condition. Stop and seek appropriate advice if you feel pain, dizziness, shortness of breath, or any other concerning symptom.

Accounts

Some features require an account. You agree to provide accurate information, keep your login details secure, and take responsibility for activity under your account. You must be old enough to form a binding agreement in your country to create an account.

Supporter memberships, donations, and purchases

Core practices are intended to be free. A deluxe supporter option may unlock additional content, and you may choose to donate to the charity.

• Purchases and subscriptions are processed by the Apple App Store or Google Play and are subject to their terms.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel a subscription in your Apple ID or Google Play account settings. Charges are billed to your Apple ID or Google Play account.
• Donations are voluntary gifts to the charity and are generally non-refundable except where required by law.

Content and intellectual property

Practices, videos, music, teachings, text, logos, and the Sri Yantra mark in the app are owned by Heart of Living Yoga or its licensors and are protected by intellectual property laws. You are granted a personal, non-transferable, non-exclusive licence to access the content for your own practice within the app.

You may not copy, record, redistribute, sell, publicly perform, or create derivative works from the content, or remove any ownership notices, without permission.

Acceptable use

You agree not to:

• Use the app for any unlawful purpose or in breach of these Terms.
• Attempt to access, download, or redistribute content outside the app's intended use.
• Interfere with, disrupt, or attempt to gain unauthorised access to the app or its systems.
• Share your account in a way that circumvents supporter or purchase requirements.

Live sessions and events

Live meditations, retreats, workshops, and training are subject to availability and may change or be cancelled. Bookings and full details for retreats and events may be handled on the Heart of Living Yoga website or by third parties, under their own terms.

Third-party services

The app relies on third-party services (including Google Firebase, the app stores, and content delivery providers) and may link to external websites. We are not responsible for the content or practices of third-party services, which are governed by their own terms.

Disclaimers

The app and its content are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that live sessions will always be available.

Limitation of liability

To the fullest extent permitted by law, Arcturus Digital Consulting Ltd and Heart of Living Yoga will not be liable for any indirect, incidental, or consequential loss arising from your use of the app. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence.

Changes and termination

We may update these Terms, and may change, suspend, or discontinue the app or any feature at any time. We may suspend or terminate access if you breach these Terms. You may stop using the app and delete your account at any time.

Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, without affecting any mandatory consumer protections available to you where you live.
